Condo#75 is a five unit condominium plan. As such it is governed by the Provincial rules set out in the "Ontario Condominums Act". This act defines the responsibilities of all residents and the Board of Directors.The Act mandates that rules be followed and one of the rules is the need to have an Annual General Meeting (AGM) where Directors are elected and motions are passed as well as receiving the financial statements for theyear. Residents are entitled to information from the Board about the finances and policies of the Corporation. However in order to run a proper meeting owners must be aware of the topics of the meeting and when and where it will be held. One of the purposes of this site is to show owners just where the information they need when participating in the governance of the Corporation. Before the AGM is held notice of the meeting must be given - twice, preliminary notice 20 days before the AGM and actual notice of meeting 15 days before the AGM.Owners may appoint a Proxy to vote for them. A Proxy form has to be filled out. Also notice must be given to the Board if an owner wishes to submit material for discussion at the AGM. During the year between AGMs Periodic Information has to be given to the owners - twice a year. Also if an owner wants to receive electronic notices instead of mailed notices then they have fill out a form and submit it to the Board. When an owner assumes ownership of a condominium, in NSCC #75, they must receive, from the lawyer a copy of the "Declaration" (the initial set ofspecific rules that tells all concerned just what the responsibilitiesof the parties to the condominium are) copies of all bylaws and a "StatusReport". These documents spell out how common elements are defined, rules about modifications and changes that can only take place with the permission of the Board. |
